ELCAN Optical Technologies is a wholly owned subsidiary of The Raytheon Company. The following terms of use apply to any visitor or user (hereinafter referred to as "User") of the website www.elcan.com and any websites that are hyperlinked to and from the website www.elcan.com (hereinafter referred to as "the Site") that the Raytheon Company or its subsidiary ELCAN Optical Technologies (hereinafter singularly and collectively referred to as "Raytheon" or "ELCAN") own and control, and to the products, services, resources, information, data, specifications, photographs, text, audio, video and any other content displayed on or collected via the Site ("Material").

By accessing the Site, submitting your resume or any other information via the Site, User acknowledges acceptance and agreement with the terms and conditions of this Privacy Policy and consents to the policies and practices described for the collection, use or disclosure of personal information. If User does not agree with these terms and conditions, User must discontinue use of the Site immediately. Note that the use of certain Material or the conduct of certain transactions on the Site may be subject to additional terms and conditions that will be made available to User prior to using such Material or completing such transactions.

PIPEDA highlights certain principles that apply to the collection, use and disclosure of your personal information which include, but are not limited to:

• Your personal information generally cannot be collected, used or disclosed without your consent; and
• You are entitled to know why your personal information is being collected, how it will be used, how it will be stored and who will have access to it.

ELCAN Optical Technologies understands and respects the importance and obligation of protecting the personal information of our website Users, customers, applicants and employees. This document, discloses ELCAN Optical Technologies’ Privacy Policy, explains how personal information will be collected, used or disclosed via the Site in accordance with and exceeding the requirements of PIPEDA (Personal Information Privacy and Electronics Documents Act) as well as the 10 Principles set out in the Canadian National Standards for the Protection of Personal Information.  We urge you to read it carefully.

1. Personal Information Collected
   
   1. To respond to User's Requests for Information, we may request such information as User's name, Business Name, Business Address, email address and/or telephone number. Users are not required to provide to us any personal information to use any other feature of the Site. Any personal information collected will not be given out to third parties, not affiliated with ELCAN Optical Technologies. Only that information which is necessary to fulfill User's requests will be collected. To the extent that User provides personal information to sites that link to or from the Site, User understands that different rules may apply to the use and disclosure of such personal information.
   2. To determine applicant suitability for posted employment positions, ELCAN Optical Technologies asks applicants to provide their names, addresses and other pertinent personal information such as work experience, education and skills.  When hiring employees, ELCAN Optical Technologies may ask for personal information that is considered “sensitive” such as information necessary to process payroll, health benefits or other information as required.  Only that information which is required to process and validate an application for employment will be collected.  Each applicant will be notified specifically as to any personal information, which must be provided to third parties, not affiliated with ELCAN Optical Technologies.
      
2. Types of Information Collected
   
   1. IP Addresses: An Internet Protocol (IP) address is automatically assigned to User's computer when User accesses the Internet, and is used by web servers to identify User's computer. When visitors access our Site, we may log the IP addresses, however, the User's identity remains anonymous to us. We log the addresses for systems administration and for auditing the use of the Site. We may also use the IP addresses to collect statistical information for marketing and other purposes.
   2. Statistical Software: Statistical software are small files that we may place on the Site, which count the number of unique Users that have visited a specific page on the Site and the number of times the page has been displayed. This information is collected only in the aggregate and is generally not linked to any personal information (except as may otherwise be provided for in Section C ii.)
   3. The information requested is otherwise limited to that which is necessary for purposes identified unless otherwise consented to by User, or required by law.
      
3. Information Use
   
   1. Use and sharing of Information: ELCAN may use any personal information User provides, unless otherwise indicated, and we will not provide your personal information to any other entity unless authorized by User. Anonymous data collected using statistical software may be analyzed in the aggregate to determine collective user characteristics to understand user traffic patterns, sales information and user behaviour (“user” in this context is a general reference term meaning any visitor to the Site, not specific Users.) Such information also may be shared in the aggregate with third parties for advertising purposes, to enhance our Site, to enhance our products and services and to analyze how and where best to put our resources.
   2. Monitoring: Although ELCAN is under no obligation to monitor the Site, we may monitor, store, review and disclose to third parties any information obtained on the Site as may be needed or requested to satisfy any applicable government law, regulation or proceeding. Additionally, we may use IP addresses to identify a particular user if we believe it is needed to enforce compliance with these terms or to protect our Company, Site or customers.
   3. Applicant’s personal information will not be used or disclosed for purposes other than for which it was collected, except with Applicant’s consent or required by law.  As managing your career is an ongoing process, Applicant’s resumes or applications are retained by ELCAN Optical Technologies for a period of no more than one year (unless transferred to an Employee File upon hiring).  Human Resources professionals and department Managers access applicant resumes and/or applications for the express purpose of determination of job suitability.
      
4. Security and Personal Information:

   Information: In order to maximize our efforts to safeguard your privacy, ELCAN utilizes a secure server for hosting as well as storage of all personal information collected on the Site. Notwithstanding the foregoing statement, while ELCAN maximizes its effort and resources to prevent third party, non-affiliate access to personal information, User understands that Internet communications may not be secure. Consequently, ELCAN cannot warrant that User’s personal information will not be disclosed to or accessed by parties other than those authorized under these terms and conditions. User agrees that ELCAN will not be liable for such disclosures of User’s personal information.

5. Updates to Your Information:

   At User’s request, ELCAN will make reasonable efforts to update, change or delete any personal information User may have earlier provided via the Site. User understands that to enforce these terms, resolve disputes or provide information to satisfy applicable government laws, regulations or proceedings, ELCAN may need to retain User’s personal information in its files. Additionally, User understands that User’s personal information may be retained in residual backup files that are a function of the network and/or server’s backup systems.  To request an update, change or deletion of personal information provided via the Site, send an email to webmaster@elcan.com with “Personal Information Update/Change/Deletion” in the subject area.

   At an Applicant’s request, ELCAN Optical Technologies will make reasonable efforts to update, change or delete any personal information provided via the Site.  Applicant understands that to enforce these terms, resolve disputes or provide information to satisfy applicable government laws, regulations or proceedings, ELCAN Optical Technologies may need to retain Applicant’s personal information in its files.  Additionally, it is understood that Applicant’s personal information may be retained in residual backup files that are a function of the network and/or server’s backup systems.  To request an update, change or deletion of Applicant personal information provided via the Site, send an email to careers.midland@elcan.com with “Applicant Personal Information” in the subject area.

6. Privacy of Children:

   The Site is not to be used by anyone under the age of eighteen (18), and any child under such age should not provide personal information. ELCAN will not knowingly collect or use personal information from any child under such age.
